I know copyright police annoy people, but you do need to be very careful about posting production music, as the “Best Endeavours” track is.

The Channel 4 News theme is available from KPM Music, a massive production music library owned by EMI, and I’m sure they’d not be too happy about their material being made so publicly available.

The laws surrounding production music state that you must own an MCPS licence if you physically manipulate any audio, which includes ripping it from CD or downloading it to your hard drive (hence “Mechanical Copyright” Protection Society).

This theme is still in copyright, and as such there is a chance those involved in posting or hosting it *could* get their hands slapped, or if they’re really unlucky, rather badly burned.

Just pointing it out for your own good… not being stroppy or preachy, or indeed ‘copyright policey’! I work with production music houses all day, everyday, and they are big companies with deep pockets and good lawyers! Please, just be careful!

i would say that the majority of everything posted on this site copyrighted material.probably everyone downloads it and listens to it for their own personal enjoyment.
i think the problem is when people use music (other than for personal use)and dont pay for using it.

I’m not starting a debate, just illustrating the facts!

The point is that production music tracks are NOT the same as jingles – they’re used to make ads for clients who are paying radio stations and production houses lots of money for the privilege. It is a COMMERCIAL PRODUCT.

I’m just trying to protect people from getting into trouble. The industry DOES know jinglemad.com exists, and the production music companies, owned by the likes of EMI, BMG and other big players, could close this site down or take legal action against it for making their COMMERCIAL works publicly available.

They will argue the point that an instrumental bed with no vocals over the top could be used for commercial gain, whereas a radio jingle with Heart 106.2 sung over the top is of little or no commercial use to anybody BUT Heart 106.2.

I see your points, gameswizard, but why is it that everytime someone posts a perfectly reasonable comment on jinglemad.com, somebody has to step in and turn it into a debate? I was not criticising anybody, just pointing out a legality which could help prevent people from getting into trouble!

i wasnt starting a debate on it.but the people who run jinglemad.com arent stupid.i’m sure that when a jingle or piece of music is uploaded they consider very carefully 😆 whether or not it should go online or not.and they have a disclaimer that if something is online that shouldnt be that it will be removed when requested by the people who own the copyright.

Dan I have mentioned this to the powers-that-be on various occasions in the past and they are quite content with the status quo (not the 3 chord group). 😈 😈 👿

I would ask, that members refrained from posting production music in the clear on Jingle Mad.

As Dan points out, it really is dodgy ground as far as copyright is concerned, and I can confirm that a copyright holder has already contacted us about something we had on here.
